These Terms of Use ("Terms") are a legal agreement between you ("you" or "Customer") and TOP 1 Air Duct Cleaning LLC ("TOP 1," "we," "us," or "our"). They govern your use of our website, your request for or receipt of any estimate, and any cleaning services we perform for you. Please read them carefully. By using the site, requesting an estimate, or allowing us to perform services, you agree to these Terms.

This website is operated and managed by OnMap Media LLC on behalf of TOP 1 Air Duct Cleaning LLC. Service requests, scheduling, and all cleaning work are performed by TOP 1 Air Duct Cleaning LLC. Website-related inquiries may be directed to OnMap Media LLC.

1. About Us & Services

Top 1 Duct Cleaning is a residential cleaning services business operating in the Greater Orlando, Florida area. We provide air duct cleaning, dryer vent cleaning, and chimney cleaning services. We do not perform HVAC installation, repair, modification, mold remediation, masonry work, or any other trade that requires a separate Florida contractor license.

2. Eligibility

You must be at least 18 years old and the owner of the property, or have the property owner's written authorization, in order to request services. By scheduling service, you represent that you meet these requirements.

3. Estimates & Pricing

All estimates are provided free of charge and without obligation. Estimates are based on the information you provide and normal residential conditions. Final pricing may differ if on-site conditions materially differ from what was described (for example: inaccessible ductwork, additional vents, structural obstructions, damaged components, or excessive contamination). We will communicate any price change to you and obtain your approval before proceeding with additional work. No verbal quote is binding until confirmed in writing.

4. Scheduling, Access & Cancellation

By scheduling an appointment, you agree to:

  • Provide accurate contact information and service address.
  • Be present, or have an authorized adult (18+) present, for the entire appointment.
  • Provide safe, unobstructed access to the work area, including attics, crawl spaces, vents, and chimneys as applicable.
  • Secure pets away from the work area throughout the appointment.
  • Disclose any known pre-existing conditions (damaged ducts, asbestos, lead paint, active pest infestations, mold, structural issues, or unsafe electrical conditions) before work begins.
  • Notify us at least 24 hours in advance if you need to reschedule or cancel. Late cancellations or no-shows may be subject to a trip-charge fee disclosed at the time of booking.

We reserve the right to refuse, pause, or terminate service if the work area is unsafe, if materially undisclosed conditions are discovered, or if continuing would risk damage to the property or injury to our crew.

5. Payment

Payment is due upon completion of services unless otherwise agreed in writing. We accept major credit cards, checks, and cash. Returned checks or declined payments may incur a reasonable processing fee. Unpaid balances accrue interest at the maximum rate permitted by Florida law and you agree to pay our reasonable collection costs and attorneys' fees for amounts that become delinquent.

6. Limited Express Warranty

We warrant that our services will be performed in a workmanlike manner consistent with industry-standard practices. If you are not satisfied with the workmanship of a service we performed, contact us within seven (7) days of the service date and we will, at our option and as our sole obligation to you, either re-perform the affected portion of the service or refund the amount paid for the affected portion. This limited warranty does not cover:

  • Pre-existing damage, wear, corrosion, or defects in the ducts, vents, chimney, HVAC system, or building.
  • Damage caused by conditions that were not disclosed to us before service.
  • Issues arising from normal use, aging, weather, or events occurring after our service.
  • Work performed by any party other than Top 1 Duct Cleaning.
  • Indoor air-quality outcomes, allergy symptoms, odors, or health outcomes, which depend on factors outside our control.

7. Disclaimer of Other Warranties

Except for the limited express warranty in Section 6, the services and this website are provided "as is" and "as available." To the fullest extent permitted by Florida law, Top 1 Duct Cleaning disclaims all other warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, workmanlike performance beyond Section 6, non-infringement, and any warranty arising out of course of dealing or usage of trade. No oral or written information provided by Top 1 or its crew creates a warranty not expressly stated in these Terms.

8. Limitation of Liability

To the fullest extent permitted by Florida law, Top 1 Duct Cleaning's total aggregate liability arising out of or related to the services, this website, or these Terms, for any and all claims, shall not exceed the amount you actually paid us for the specific service giving rise to the claim. In no event shall Top 1 be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, loss of use, loss of profits, loss of data, diminution in value, or damages for mental anguish or inconvenience, even if advised of the possibility of such damages.

Nothing in these Terms limits or excludes liability for: (a) gross negligence or willful misconduct; (b) personal injury or death caused by our negligence; (c) fraud or fraudulent misrepresentation; or (d) any other liability that cannot lawfully be limited or excluded under Florida law. This Section 8 is a material part of the bargain between you and Top 1.

9. Indemnification

You agree to defend, indemnify, and hold harmless Top 1 Duct Cleaning, its owners, employees, and crew from and against any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your misrepresentation or failure to disclose pre-existing conditions; (c) your violation of any law; or (d) the condition of the property when not caused by our work.

10. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including severe weather, hurricanes, floods, fires, utility outages, governmental orders, public-health emergencies, labor disruptions, or supply-chain failures.

11. Electronic Communications & Consent

When you provide your phone number or email through our website, call us, or schedule a service, you consent to receive communications from us at those contact points regarding your estimate, appointment, and services. If you separately opt in (for example, by checking a consent box), you additionally agree to receive marketing or promotional calls and text messages, which may be sent using automated technology. Consent to marketing is not a condition of any purchase. Message and data rates may apply. You may opt out of marketing messages at any time by replying STOP to a text, clicking unsubscribe in an email, or contacting us. See our Privacy Policy for details.

12. Intellectual Property

All content on this website — including text, graphics, logos, icons, images, and the overall layout — is owned by Top 1 Duct Cleaning or its licensors and is protected by United States copyright, trademark, and other intellectual-property laws. You may view the site for personal, non-commercial use. You may not copy, reproduce, modify, distribute, display, publish, or create derivative works from any content on this site without our prior written permission.

13. Third-Party Links & Services

Our website may contain links to third-party websites or services (for example, WhatsApp, Google Maps, or payment processors) that we do not control. We are not responsible for the content, privacy practices, or terms of those third parties. Your use of third-party services is at your own risk.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page and revise the "Last updated" date above. Material changes will be effective when posted. Your continued use of the site or our services after changes are posted constitutes your acceptance of the updated Terms. We recommend reviewing this page periodically.

15. Dispute Resolution — Informal Resolution First

Before filing any claim, you agree to first contact us in writing at info@top1airductcleaning.com and provide a brief description of the dispute and your contact information. We will attempt to resolve the dispute informally within thirty (30) days. This informal step is a condition precedent to any formal proceeding.

16. Binding Arbitration & Class-Action Waiver

Please read this section carefully. It affects your legal rights. Except for claims that may be brought in small-claims court and claims for injunctive relief to protect intellectual property, any dispute, claim, or controversy arising out of or relating to these Terms, the website, or the services — whether in contract, tort, statute, or otherwise — shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Orlando, Florida, or by telephone or video at the consumer's election. The Federal Arbitration Act governs the interpretation and enforcement of this Section.

Class-action waiver: You and Top 1 agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is found to be unenforceable as to a particular claim, then that claim (and only that claim) shall be severed and brought in court, while all other claims proceed in arbitration.

17. Governing Law & Venue

These Terms and any dispute arising under them are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. For any claim that is not subject to arbitration (for example, small-claims matters or injunctive-relief claims), the exclusive venue shall be the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of those courts.

18. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. These Terms, together with the Privacy Policy and any service quote or invoice we provide, constitute the entire agreement between you and Top 1 Duct Cleaning regarding the subject matter and supersede any prior or contemporaneous understandings.
